SAN DIEGO – A Riverside couple alleges that their 2010 diesel Volkswagen Jetta violated U.S. environmental law because it came with a "defeat device" that would temporarily reduce emissions in order for the car to pass inspection.
Sheryl Dameron and David Dameron filed a complaint on April 20 in the U.S. District Court for the Southern District of California against Volkswagen Aktiengesellschaft and Volkswagen Group of America Inc. citing alleged breach of implied warranty, fraud and other counts.
According to the complaint, the plaintiffs allege that they purchased their car in Nov. 17, 2010. The plaintiffs hold Volkswagen Aktiengesellschaft and Volkswagen Group of America Inc. responsible because the defendants allegedly manufactured their cars with a defeat device despite having environmental laws in place. They allege they would have not purchased the vehicle or paid a reduced cost for it had they known of the defect.
The plaintiffs request a trial by jury and seek actual damages according to proof, restitution, punitive damages, consequential and incidental damages, all legal fees and any other relief as this court deems just. They are represented by Stephen G. Recordon of Recordon & Recordon in San Diego.
