SAN FRANCISCO – A Santa Clara County business is facing a class-action suit from a former employee over allegations of unpaid overtime.
Ramon Agustin filed a complaint on behalf of those similarly situated persons on April 27 in the U.S. District Court for the Northern District of California against The Blue Mango and Boontawee Kaplan, citing violation of the Fair Labor Standards Act and California labor codes.
According to the complaint, the plaintiff alleges that during his employment with the defendants, he worked for more than 40 hours but was not paid any overtime wages nor given the correct minimum wage rate. The plaintiff holds The Blue Mango and Boontawee Kaplan responsible because the defendants allegedly failed to pay overtime wages at the correct rate according to the FLSA.
The plaintiff requests a trial by jury and seeks compensatory and economic damages, liquidated damages, interest, unpaid overtime and minimum wage, compensation for failure to make immediate payment of wages to plaintiff upon discharge, permanent injunctive order against the defendants, all legal fees and any other relief as this court deems just.
