FOX Factory Inc. files patent infringement suit against RockShox makers

SAN FRANCISCO – A Scotts Valley corporation alleges a Chicago company manufactures bicycle parts that infringe two patents.

FOX Factory Inc. filed a complaint on July 1 in the U.S. District Court for the Northern District of California against SRAM LLC alleging patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its patented design being infringed and sold to consumers by the defendant, the makers of RockShox products. The plaintiff holds SRAM LLC responsible because the defendant allegedly manufactured bicycle suspension forks that infringes claims of the '172 and '009 patents.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing the said patents, order the defendant to deliver up for destruction all infringing products, actual damages, interest, all legal fees and any other relief as the court deems just. It is represented by Robert F. McCauley, Jeffrey D. Smyth and Christopher B. McKinley of Finnegan, Henderson, Farabow, Garrett & Dunner LLP in Palo Alto.
