Quibids alleged to have sent spam email

SAN FRANCISCO – Two individuals have filed a suit alleging they were sent spam email without their consent.

Andreas Falley and Jung Kim filed a complaint on July 1 in the U.S. District Court for the Northern District of California against Quibids LLC, Quibids Holdings LLC, Flex Marketing Group LLC and Does 1-100 alleging unlawful unsolicited commercial emails in violation of state business and professions codes.

According to the complaint, the plaintiffs allege that they were sent several spam email advertisements from the defendants without their consent. The plaintiffs holds Quibids LLC, Quibids Holdings LLC, Flex Marketing Group LLC and Does 1-100 responsible because the defendants allegedly sent spam emails that did not identify them as the sender.

The plaintiffs request a trial by jury and seek liquidated damages of $1,000 per unlawful email message, equitable and injunctive relief, all legal fees and interest, and any other relief as the court deems just. They are represented by Timothy J. Walton and Jim Twu of Walton Twu LLP in Aptos.
