Finjan Inc. accuses ESET of patent infringement

SAN FRANCISCO – An East Palo Alto company has filed suit against a San Diego company in a dispute over online security software.

Finjan Inc. filed a complaint on July 1 in the U.S. District Court for the Northern District of California against ESET LLC and ESET SPOL. S.R.O. alleging that they infringed several patents currently registered to plaintiff.

According to the complaint, the plaintiff alleges that Finjan Inc. suffered damages to its business as a result of its patents '086, '621, '755, '844, '780 and '305 being used without its consent by the defendants in its anti-malware software. The plaintiff holds ESET LLC and ESET SPOL. S.R.O. responsible because the defendants allegedly made and distributed protection products, which contain qualities that infringe the patents.

The plaintiff requests a trial by jury and seeks injunction against the defendants from infringing plaintiff's patents, all damages no less than $44 million, all legal fees interest, and any other relief as the court deems just. It is represented by Paul J. Andre, Lisa Kobialka and James Hannah of Kramer Levin Naftalis & Frankel LLP in Menlo Park.
