Former employee alleges Cepheid did not pay overtime wages

SAN FRANCISCO – A Delaware man employed as a field service engineer has filed a class-action lawsuit against a Sunnyvale company alleging he was not paid overtime wages.

Stuart Higginbotham filed a complaint on behalf of others similarly situated on July 11 in the U.S. District Court for the Northern District of California against Cepheid alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between October 2014 and June, he worked for more than 40 hours per workweek without being paid any overtime wages by the defendant. The plaintiff holds Cepheid responsible because the defendant allegedly failed to pay overtime compensation to plaintiff for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks all unpaid overtime wages, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Matthew C. Helland and Daniel S. Brome of Nichols Kaster LLP in San Francisco.
