Secretary of labor files suit against West Coast Drywall & Co. Inc.

LOS ANGELES – A Riverside business and its executives are facing allegations that they did not pay their employees overtime wages.

Secretary of Labor Thomas E. Perez filed a complaint on July 18 in the U.S. District Court for the Central District of California against West Coast Drywall & Co. Inc., Mark D. Herbert and Santos Garcia alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that the defendants allegedly failed to pay any overtime compensation at a rate of time-and-one-half to their employees for working more than 40 hours per workweek and did not keep accurate records.

The plaintiff seeks to permanently enjoin the defendants, all unpaid overtime compensation due to their employees, liquidated damages equal to the unpaid overtime compensation, back wages, all legal fees and any other relief as the court deems just. He is represented by Janet M. Herold, Susan Seletsky, Boris Orlov, and Grace A. Kim of U.S. Department of Labor in Los Angeles.
