Suit filed against city of Lincoln over wage allegations

SACRAMENTO – A class-action suit has been filed by a public employee alleging he and other employees were not paid overtime.

Richard MacCracken filed a complaint on behalf of all similarly situated individuals on July 20 in the U.S. District Court for the Eastern District of California against the city of Lincoln violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per workweek without being paid any overtime premium for hours by the defendant. The plaintiff holds the city of Lincoln responsible because the defendant allegedly failed to pay overtime compensation at a rate of one-and-one half to plaintiff.

The plaintiff seeks unpaid overtime wages and interest, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt APC in Sacramento.
