LOS ANGELES – A man employed at an Ohio call center for a company headquartered in Los Angeles alleges he and other class members were not properly paid for all hours worked.
Cody Livingston filed a class-action complaint on behalf of all others similarly situated on July 21 in the U.S. District Court for the Central District of California against VXI Global Solutions LLC alleging violation of the Fair Labor Standards Act and other counts.
According to the complaint, the plaintiff alleges that since December 2015, he worked for more than 40 hours per workweek without being paid any overtime premiums for hours. The plaintiff holds VXI Global Solutions LLC responsible because the defendant allegedly failed to pay any overtime compensation at a rate of one-and-one-half times to plaintiff for all hours worked.
The plaintiff requests a trial by jury and seeks unpaid wages plus interest, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Taras Kick of The Kick Law Firm APC in Santa Monica; Peter Winebrake, R. Andrew Santillo and Mark J. Gottesfeld of Winebrake & Santillo LLC in Dresher, Pennsylvania; and Jerry Martin and David Garrison of Barrett Johnston Martin & Garrison LLC in Nashville, Tennessee.
