SAN FRANCISCO – A Mountain View technology company is seeking declaration from the court over accusations that it infringed a patent.
Google Inc. filed a complaint on July 25 in the U.S. District Court for the Northern District of California against IXI Mobile (R&D) LTD and IXI IP LLC seeking declaratory judgment of noninfringement.
According to the complaint, the plaintiff alleges that Google Inc. suffered damages to its business as the result of being accused of patent infringement by the defendants. The plaintiff states IXI Mobile (R&D) LTD and IXI IP LLC filed four lawsuits against it for patent infringement claiming that it distributes devices that infringes the defendants' 124 patent.
The plaintiff requests a trial by jury and seeks declare that plaintiff does not infringe the '124 patent, all legal fees and any other relief as the court deems just. It is represented by Sean Pak of Quinn Emanuel Urquhart & Sullivan LLP in San Francisco.
