LOS ANGELES – A construction company and its insurers are accused of not paying a balance in full after completing a construction project.
United States, for the use of Northwest Excavating Inc., filed a complaint on July 27 in the U.S. District Court for the Central District of California against Howard Contracting Inc., Walsh Construction Co. II LLC., Travelers Casualty and Surety Co. of America and Suretec Insurance Co., citing breach of contract and other counts.
According to the complaint, the plaintiff alleges that it suffered damages for not being paid for furnishing equipment and labor for the use of a construction project on a government-run health care facility in Loma Linda. The plaintiff holds Howard Contracting Inc., Walsh Construction Co. II LLC., Travelers Casualty and Surety Co. of America and Suretec Insurance Co. responsible because the defendants allegedly paid plaintiff partially but left an unpaid balance of $202,240.
The plaintiff seeks sum of $202,240 plus interest at the rate of 18 percent per annum until paid, all legal fees and any other relief as the court deems just. They are represented by Howard Goodman of Law Offices of Howard Goodman in Tarzana.
