Harbor Freight Tools alleges company hired for returns management did not honor contract

LOS ANGELES – A Calabasas tool company alleges a Pittsburgh wholesale retailer return business did not perform as promised.

Harbor Freight Tools USA Inc. filed a complaint on July 29 in the U.S. District Court for the Central District of California against Genco Marketplace Inc. and Does 1 through 10 alleging breach of contract, promissory fraud, unfair competition and other counts.

According to the complaint, the plaintiff alleges that in 2015, it and the defendant entered into a contract in which the defendant agreed to purchase the plaintiff's liquidation merchandise and handle returns management operations. The plaintiff holds Genco Marketplace Inc. and Does 1 through 10 responsible because the defendants allegedly did not perform as promised and threw out products, sold plaintiff's products at below-market prices and other claims. The plaintiff alleges it has lost more than $700,000 as a result of the defendant's actions.

The plaintiff requests a trial by jury and seeks actual compensatory and consequential damages, interest, all legal fees and any other relief as the court deems just. It is represented by Eileen Ahern and Rebecca T. Green of Willenken Wilson Loh & Delgado LLP in Los Angeles.
