Pet Sit Pros Inc. claims former employee is using mark, soliciting clients

LOS ANGELES – A pet sitting company based in Los Angeles County alleges a former employee is using its mark for his own business.

Pet Sit Pros Inc. filed a complaint on Aug. 2 in the U.S. District Court for the Central District of California against Pet Sitting Professionals LLC, Francisco Javier Fernandez and Does 1-25 alleging trademark infringement, unfair competition and other counts.

According to the complaint, the plaintiff alleges that Pet Sit Pros Inc. suffered damages to its business as the result of their trademark being used without their authority by Fernandez. The plaintiff holds Pet Sitting Professionals LLC, Fernandez and Does 1-25 responsible because the defendants allegedly used plaintiff's trademark, which it claims is likely to cause confusion among plaintiff's consumers, and has solicited clients away from the plaintiff's business.

The plaintiff requests a trial by jury and seeks enjoin the defendant, award plaintiff all damages and profits, damages not less than $1,000,000, all legal fees and any other relief as this court deems just. It is represented by Amy Yeh of Law Offices of Amy Yeh in Montebello.
