SAN FRANCISCO – A former senior personal banker alleges her disability benefits were wrongfully terminated.

Joelle Neville filed a complaint on Aug. 2 in the U.S. District Court for the Northern District of California against America Group Benefits Program, Bank of America NA, Bank of America Corporate Benefits Committee and Aetna Life Insurance Co.  alleging that they terminated plaintiff's disability benefits.

According to the complaint, the plaintiff alleges that in June 2012, she became disabled due to a paralysis of the vocal cords and was paid disability benefits until it was terminated on June 9, 2014, by the defendant. The plaintiff holds the defendants responsible because the defendants allegedly terminated plaintiff's disability benefits based on their claim that the plaintiff is no longer disabled based on the terms of the plan.

The plaintiff seeks the award of benefits due under the plan plus interest, attorneys' fees of $150,000 or according to proof and any further relief as the court deems just. She is represented by Laurence F. Padway of Law Offices of Laurence F. Padway in Alameda and David J. Linden in Napa.
