LOS ANGELES – A Los Angeles woman alleges a debt collector called her at a harassing rate.
Hilary Davies filed a complaint on Aug. 3 in the U.S. District Court for the Central District of California, Eastern Division against Lendingclub Corp. alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in 2015, she was continually contacted on her cellular telephone by the defendant in an attempt to collect a purported loan despite her request to stop calling her. The plaintiff holds Lendingclub Corp. responsible because the defendant allegedly contacted plaintiff several times using an automatic telephone dialing system.
The plaintiff seeks statutory damages, punitive damages, interest, injunctive relief, all legal fees and any other relief as the court deems just. She is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
