LOS ANGELES – The trustees of labor union funds allege an employer will not let them conduct an audit.
Brent Beasley, Ernest Glasgow, Cliff Smith, Greg Banks, trustees of the Union Roofers Supplemental Annuity Trust, Union Roofers Health & Welfare Fund, Union Roofers Vacation Fund, Union Roofers Administrative Fund, Union Roofers Joint Apprenticeship and Training Fund, Pacific Coast Roofers Pension Plan filed a complaint on Aug. 5 in the U.S. District Court for the Central District of California against Klondike Construction Services Inc., doing business as Klondike Roof Construction Service and also known as Klondike Contracting, and Does 1 through 10 alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they suffered damages as the result of being refused to conduct an audit of the defendants' business records. The plaintiffs hold Klondike Construction Services Inc., doing business as Klondike Roof Construction Service and also known as Klondike Contracting, and Does 1 through 10 responsible because the defendants allegedly refused the trust funds to conduct an audit of their business records according to their master labor agreement.
The plaintiffs seek order the defendants to submit to completion of an audit of employer business records; allow the auditors to examine and copy the following books, records, papers documents and reports; all legal fees; and any other relief as this court deems just.
