SAN FRANCISCO – An electrical installation, construction and maintenance company doing business in San Francisco County is accused of not paying contributions to labor union funds.
Electrical Industry Service Bureau Inc., Northern California Electrical Workers Pension Trust, San Francisco Electrical Industry Apprenticeship and Training Trust, et al. filed a complaint on Aug. 9 in the U.S. District Court for the Northern District of California against Crown Electric Inc., Alvin Rudolph Mesita, Christopher Blake Powell and Nisha Chaudry alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs holds Crown Electric Inc., Alvin Rudolph Mesita, Christopher Blake Powell and Nisha Chaudry responsible because the defendants allegedly failed to pay their monthly contributions to the labor group on behalf of their employees in violation of a bargaining agreement between the parties.
The plaintiffs seek unpaid principal approximately $7,905.62 for the month of September 2015, audit shortages currently estimated to be approximately $14,649.86, liquidated damages of approximately $1,861.70, collection costs, including audit fees of approximately $11,790, interest, all legal fees and any other relief as the court deems just.
