SANTA ANA – An individual has filed a class-action lawsuit against Hyundai Capital America alleging it has called him for years in an attempt to reach another person.
Jeremy Klein filed a complaint on behalf of all others similarly situated on Aug. 9 in the U.S. District Court for the Central District of California, Southern Division against Hyundai Capital America, doing business as Hyundai Motor Finance, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that he experienced frustration and inconvenience from being contacted several times on his cellular telephone by the defendant in its attempt to reach another person. The plaintiff holds Hyundai Capital America responsible because the defendant allegedly used an automatic dialing system to contact plaintiff even without his consent and continued to call despite his requests to stop.
The plaintiff requests a trial by jury and seeks statutory damages, injunctive relief, declaratory relief and any other relief as the court deems just. He is represented by Trinette G. Kent, of counsel to Lemberg Law LLC in Wilton, Connecticut.
