Ocean World faces suit from patron alleging she was injured while on tour

SAN FRANCISCO – An Oregon woman has filed suit against the owners of Ocean World alleging she was injured while on a tour.

Karen Milner filed a complaint on Aug. 9 in the U.S. District Court for the Northern District of California against Dean Wilson and Mary Wilson individually, doing business as Ocean World, and in their capacity as Trustees of the Wilson Family Trust and Does 1 through 4 alleging premises liability.

According to the complaint, the plaintiff alleges that on Aug. 26, 2014, she sustained physical injuries when she stepped on a wet concrete on the defendants' property, causing her to fall on her shoulder. The plaintiff holds the defendants responsible because the defendants allegedly failed to maintain their concrete-enclosed tank to prevent leaks or provide adequate warnings regarding the unsafe nature of the area.

The plaintiff requests a trial by jury and seeks noneconomic damages in the amount of $400,000, economic damages for all medical expenses in the amount of $72,473.18, future wage losses and past and future losses of earning capacity in the amount of $250,000, all legal fees and any other relief as the court deems just. She is represented by Dennis H. Black of Black, Chapman, Petersen & Stevens in Medford, Oregon.
