SAN FRANCISCO – Several trust funds claim an Alameda company has failed to pay contributions per a bargaining agreement between the parties.
District Council 16 Northern California Health and Welfare Trust Fund, Northern California Glaziers, Architectural Metal and Glass Workers Pension Trust Fund, Northern California Glaziers Individual Account Retirement Trust Fund, et al. filed a complaint on Aug. 10 in the U.S. District Court for the Northern District of California against QOL Corp., doing business as Custom Engineered Openings Windows and Doors, alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they sustained damages as the result of unpaid contributions. The plaintiffs hold QOL Corp. responsible because the defendant allegedly failed to pay monthly contributions on behalf of their employees from March 1, 2015, to July 31, 2015, and other months in 2015 and 2016.
The plaintiffs seek any unpaid contributions, liquidated damages on all late and unpaid contributions, interest on all late and unpaid contributions, all legal fees and any other relief as the court deems just.
