LOS ANGELES – Three companies are accused of selling garments that use a copyrighted fabric pattern without permission.
Unicolors Inc. filed a complaint on Aug. 10 in the U.S. District Court for the Central District of California against Skiva International Inc., Boscov's Department Store LLC, Ross Stores Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages as the result of its textile design being used without its authority. The plaintiff holds Skiva International Inc., Boscov's Department Store LLC, Ross Stores Inc. and Does 1 through 10 responsible because the defendants allegedly manufactured and sold garments comprised of fabrics bearing the same designs as plaintiff.
The plaintiff requests a trial by jury and seeks award profits and damages to plaintiff derived from the unlawful act, enjoin the defendant from further infringing plaintiff's designs, interest, all legal fees and any other relief as the court deems just.
