Woman alleges disability benefits were wrongfully terminated

LOS ANGELES – A Ventura County woman seeks the court's declaration that she is disabled and entitled to reinstatement of her disability benefits.

Cassandra Sliwoski filed a complaint on Aug. 15 in the U.S. District Court for the Central District of California against the Sedgwick CMS, Southern California Edison Co., Southern California Edison Co. Long Term Disability Plan and Does 1 through 10 alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in November 2014, she became disabled and received benefits until they were terminated by the defendants in November 2015. The plaintiff holds Sedgwick CMS, Southern California Edison Co., Southern California Edison Co. Long Term Disability Plan and Does 1 through 10 responsible because the defendants allegedly denied further payments to plaintiff's disability benefits despite her being disabled according to the terms of the plan.

The plaintiff seeks declaration from the court that she is still disabled, all past-due benefits plus interest, declare that plaintiff is entitled to receive benefits for as long as she remains disabled, all legal fees and any other relief as the court deems just. She is represented by Charles J. Fleishman and Paul A. Fleishman of The Fleishman Law Firm in Woodland Hills.
