SAN FRANCISCO -- A board of trustees representing the California Machinists 401(K) trust fund has filed suit against a group of defendants for allegedly failing to pay their union dues.
The board of trustees in their capacities as trustees of the California Machinists 401(K) Trust Fund filed a complaint on Aug. 15 in U.S. District Court for the Northern District of California against Sonic Automotive Inc., Sonic - Stevens Creek B Inc., doing business as Steven Creek BMW, and Franciscan Motors Inc., doing business as Acura of Serramonte, citing alleged breach of contract.
According to the complaint, the plaintiffs allege that the board of trustees suffered damages from unpaid contributions. The plaintiffs hold Sonic Automotive Inc., Sonic - Stevens Creek B Inc. and Franciscan Motors Inc. responsible because the defendants allegedly breached their bargaining agreement with the plaintiff by failing to pay their monthly contributions on behalf of their employees.
The plaintiffs seek underpaid contributions of $12,087.38 for the defendant Sonic and Stevens Creek, $6,145.00 for the defendants Sonic and Franciscan Motors, liquidated damages in the amount of $1,640.20, interest, actual damages, all legal fees and any other relief as the court deems just. They are represented by William A. Sokol and Kristina Zinnen of Weinberg, Roger, & Rosenfeld in Alameda.
