LOS ANGELES – The owner of the Lady Luck and Lucky Lady trademarks alleges its trademarks were used on a new casino in Gardena without authorization.
Isle of Capri Casinos Inc. filed a complaint on Aug. 16 in the U.S. District Court for the Central District of California against Larry Flynt, as individual and as trustee of the Larry Flynt Revocable Trust Casino LLC, and Does 1 through 10 alleging trademark infringement, false designation of origin and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its business from having its Lady Luck and Lucky Lady trademarks used without its authority. The plaintiff holds Larry Flynt, as individual and as trustee of the Larry Flynt Revocable Trust Casino LLC, and Does 1 through 10 responsible because the defendants allegedly used plaintiff's trademark on their newly opened casino despite plaintiff's demand to cease using its trademark.
The plaintiff requests a trial by jury and seeks injunction against the defendant, destroy all infringing materials, actual damages, statutory damages, damages sufficient to compensate plaintiff, disgorgement, all legal fees and interest, engage in a corrective advertising, and any other relief as the court deems just.
