Man claims insurance company wrongfully denied his disability claim

LOS ANGELES — A former employee has filed suit against a life insurance company for allegedly canceling his disability payments.

Donte Recarto Kirksey filed a complaint on Aug. 18 in U.S. District Court for the Central District of California against Life Insurance Co. of North America, alleging that the insurance firm denied the plaintiff's claim for disability benefits.

According to the complaint, the plaintiff alleges that between 2013 and 2014, he became disabled and filed a claim for disability benefits, but was denied. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny disability benefits to the plaintiff despite being disabled according to the terms of the plan.

The plaintiff seeks benefits due to him plus interest, an order that plaintiff is entitled to future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
