Bicyclist allegedly claims she was hit by a car, Nationwide Insurance Co. denies coverage

SACRAMENTO — An insurance company has filed suit against a policyholder who claims she was struck by a car while riding her bicycle and sustained injuries. 

Nationwide Insurance Co. of America filed a complaint on Aug. 19 in U.S. District Court for the Eastern District of California, Sacramento Division, against Cynthia Marquez, alleging that the individual falsely filed a claim seeking the plaintiff's uninsured motorist coverage.

According to the complaint, the plaintiff alleges that Nationwide Insurance Co. of America suffered damages. The plaintiff holds Cynthia Marquez responsible because the defendant allegedly claims that she is entitled to uninsured motorist coverage despite failing to provide adequate evidence to support her claim, specifically that she was hit by a vehicle.

The plaintiff requests a trial by jury and seeks declaration that the plaintiff has no obligation to provide uninsured motorist coverage to the defendant, declare that the defendant's claim for uninsured motorist benefits is not arbitrable, all legal fees and any other relief as the court deems appropriate. The plaintiff is represented by Karen L. Uno and David P. Borovsky of Cozen O'Connor in San Francisco.
