Bay Area Painters and Tapers Pension Trust Fund alleges it is owed more than $60,000

SAN FRANCISCO – A labor union trust fund and its board of trustees allege a Rio Linda employer owes more than $60,000 in unpaid withdrawal liability fees.

Bay Area Painters and Tapers Pension Trust Fund and its board of trustees, Chris Christophersen and Marian Bourboulis, filed a complaint on Aug. 29 in the U.S. District Court for the Northern District of California against the Horizon Painting, New Horizon Painting, Horizon Bros. Painting, Dimitrios P. Rozakis, Emmanuel M. Rozakis and Does 1-10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid contributions. The plaintiffs holds Horizon Painting, New Horizon Painting, Horizon Bros. Painting, Dimitrios P. Rozakis, Emmanuel M. Rozakis and Does 1-10 responsible because the defendants allegedly breached their bargaining agreement with plaintiffs by making a complete withdraw from participation in the plan in July 2014 but did not pay the withdrawal liability.

The plaintiffs seek the sum of $61,450 for the unpaid withdrawal liability, interest rate of 6.5 percent, liquidated damages, all legal fees and any other relief as the court deems just. They are represented by Anne M. Bevington, Shaamini A. Babu, and Allan D. Shuldiner of Saltzman & Johnson Law Corp. in San Francisco.
