Sister of deceased policyholder alleges life insurance companies have not paid out the policies

SAN FRANCISCO — The sister of a policyholder who was struck and killed by a car has filed suit against two life insurance companies.

Myra Sugiyama filed a complaint Aug. 31 in U.S. District Court for the Northern District of California against Unum Life Insurance Co. of America and Cooley LLP Health and Welfare Plan, alleging that they failed to notify her that they had not yet made a decision regarding the benefit claim she made as the primary beneficiary of her brother's policies after his death.

According to the complaint, the plaintiff alleges that in 2016, she suffered damages from being deprived of the accidental death and disability benefits to which she supposedly was entitled. The plaintiff holds Unum Life Insurance Co. of America and Cooley LLP Health and Welfare Plan responsible because the defendants allegedly breached their contract by failing to pay the plaintiff the benefits entitled to her.

The plaintiff seeks an award of $550,000 in benefits under the plan plus interest, all legal fees and any other relief as the court deems just. She is represented by Kathryn C. Curry and Anne S. Lawer of GCA Law Partners LLP in Mountain View.
