K-Mart alleged infringed Korean companies' patent by selling Kodak LED product

Patents 08

LOS ANGELES — Korean companies have filed suit against a major chain of stores for alleged patent infringement by selling a Kodak product that infringes their LED lighting patent.

Seoul Semiconductor Co. Ltd. and Seoul Viosys Co. Ltd. filed a complaint Sept. 9 in U.S. District Court for the Central District of California against K-Mart Corp., alleging that the corporation infringed the plaintiff's 731 patent.

According to the complaint, the plaintiffs allege that Seoul Semiconductor Co. Ltd. and Seoul Viosys Co. Ltd. suffered damages to their business. The plaintiffs hold K-Mart Corp.n responsible because the defendant allegedly imported and/or distributes Spotlite’s Kodak LED Lighting Bulb 41063 which infringes the plaintiff's patents.

The plaintiffs request a trial by jury and seek an injunction against the defendant from further infringing the plaintiff's patents, to award damages to the plaintiff plus interest, all legal fees and any other relief as this court deems just. They are represented by Bradley A. Hyde of Latham & Watkins LLP in Costa Mesa, Lawrence J. Gotts of Latham & Watkins LLP in Washington, D.C., and Charles H. Sanders of Latham & Watkins LLP in Boston.
