Wal-Mart, others alleged to have used copyrighted fabric design without authorization

LOS ANGELES – Wal-Mart Stores Inc. and others are facing accusations from a Los Angeles company that it used a copyrighted textile design for clothing without permission.

Urban Textile Inc. filed a complaint on Sept. 9 in the U.S. District Court for the Central District of California against Fashion Avenue Knits Inc., Wal-Mart Stores Inc., White Stag Manufacturing Co., and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that is the owner of a design titled UB-4816 that was registered in 2014. The plaintiff holds Fashion Avenue Knits Inc., Wal-Mart Stores Inc., White Stag Manufacturing Co. and Does 1-10 responsible because the defendants allegedly copied plaintiff's proprietary design without its permission and used it to manufacturer and sell clothing.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, award all profits to plaintiff, all legal fees and interest, plus any other relief as the court deems just. It is represented by C. Yong Jeong of Jeong & Likens LC in Los Angeles.
