The Winsford Corp. alleges AMTEX uses similar mark

LOS ANGELES – A Los Angeles corporation alleges that a San Bernardino corporation is using a similar trademark.

The Winsford Corp. filed a complaint on Sept. 9 in the U.S. District Court for the Central District of California against American Tex-Chem Corp., doing business as AMTEX, citing trademark infringement, false designation of origin and other counts.

According to the complaint, the plaintiff manufactures hotel equipment using a birdcage design mark. The plaintiff holds American Tex-Chem Corp. responsible because the defendant allegedly used a confusingly similar design to plaintiff's birdcage design on its products.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, order the defendant to turn over all infringing materials to plaintiff, compensatory damages exceeding $500,000, punitive and exemplary damages, statutory damages in the amount of $2 million, all legal fees and any other relief as the court deems just.
