Sodexo Inc., SDH Services West LLC alleged to have not properly compensated employees

SACRAMENTO – Four San Joaquin County residents have filed a class-action suit against their former employer over allegations of labor law violations.

Maria Luisa Mejia, Elvira Mungia Lopez, Maria Benavidez and Martin Monter filed a complaint on behalf of other current and former employees on Sept. 6 in the U.S. District Court for the Eastern District of California against Sodexo Inc., SDH Services West LLC, and Does 1 through 20 citing the Fair Labor Standards Act and state labor laws.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours without being paid any overtime compensation or the regular rate of pay, were not paid minimum wage or granted rest and meal breaks. They also allege the defendants did not maintain accurate timekeeping records, did not pay all wages owed at termination and other counts.

The plaintiffs request a trial by jury and seek compensatory damages, including minimum wages, double minimum wages, overtime wages, premium rest and meal period premium wages plus interest; restitution; premium pay; wages; penalties; interest; liquidated damages; all legal fees and any other relief as the court deems just. They are represented by Stan S. Mallison, Hector R. Martinez, Marco A. Palau, Joseph D. Sutton and Eric C. Trabucco of Mallison & Martinez in Oakland.
