Republic Services Inc. alleged to owe employee contributions

OAKLAND – A labor group alleges an employer did not pay contributions for four years.

ILWU Warehouse Welfare Trust; and James Beard and Larry Morrison, as trustees of the ILWU Warehouse Welfare Trust, filed a complaint on Sept. 6 in the U.S. District Court for the Northern District of California, Oakland Division against Republic Services Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages from unpaid contributions. The plaintiffs hold Republic Services Inc. responsible because the defendant allegedly breached their agreement with plaintiff by failing to pay their contributions on behalf of their employees from 2008 to 2012.

The plaintiffs seek unpaid contributions, liquidated damages, interest on all late paid and unpaid contributions, reimbursement of plaintiff's expenses, all legal fees and any other relief as the court deems just. They are represented by Ana P. Hallmon and Edward D. Winchester of Saltzman & Johnson Law Corp. in San Francisco.
