The Buckle Inc. accused of selling clothing that infringes copyrighted design

LOS ANGELES – A Los Angeles company is accusing a Nebraska business of selling clothing using a fabric design that is similar or identical to its copyrighted design.

Unicolors Inc. filed a complaint on Sept. 13 in the U.S. District Court for the Central District of California against The Buckle Inc. and Does 1-10 citing copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its design EH101 used without its consent. The plaintiff holds The Buckle Inc. and Does 1-10 responsible because the defendants allegedly sells garments fabrics that bear a confusingly similar design as plaintiff's design.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's designs, award plaintiff all profits, statutory damages, all legal fees and interest and any other relief as the court deems just.
