Woman alleges Diversified Adjustment Service continued calls after instructed to contact attorney

SAN FRANCISCO – A San Pablo consumer alleges a debt collector continued to contact her after she instructed it to contact her lawyer.

Kendra Derden filed a complaint on Sept. 8 in the U.S. District Court for the Northern District of California against Diversified Adjustment Service Inc. and Does 1 through 10 citing the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2015, retained a lawyer to represent her regarding an alleged debt purchased by the defendant. The plaintiff holds Diversified Adjustment Service Inc. and Does 1 through 10 responsible because the defendants allegedly violated the FDCPA by calling her multiple times despite being notified that she was already being represented by a law firm.

The plaintiff requests a trial by jury and seeks statutory damages of $2,000, actual damages, all legal fees and any other relief as the court deems just. She is represented by Mathew K. Higbee and Katherine A. Sandoval of Higbee & Associates in Santa Ana.
