Performant Financial Corp. accused of invading privacy with autodialed calls

SAN FRANCISCO – An Ohio man has filed a class-action lawsuit against a Livermore corporation over its calls, alleging it has invaded his privacy.

Timothy Glick filed a complaint on behalf of all others similarly situated on Sept. 23 in the U.S. District Court for the Northern District of California against Performant Financial Corp., alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that since 2012, the defendant has called him several times seeking a Michele Brookes. He alleges he has told the defendant repeatedly that it has the wrong number and to stop calling, but the calls continue. The plaintiff holds Performant Financial Corp. responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff.

The plaintiff requests a trial by jury and seeks actual and statutory damages, disgorgement of funds, enjoin the defendant, all legal fees plus interest and any other relief as this court deems just.
