Unicolors Inc. claims Zulily, Hemisphere World Wide Sales used copyrighted textile design

LOS ANGELES – A Vernon company alleges a Miami Beach corporation and a Washington corporation sold products bearing its designs.

Unicolors Inc. filed a complaint on Sept. 22 in the U.S. District Court for the Central District of California against the Hemisphere World Wide Sales Inc., Zulily LLC and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its copyrighted designs used on other fabric without its consent. The plaintiff holds Hemisphere World Wide Sales Inc., Zulily LLC and Does 1-10 responsible because the defendants allegedly sold garments in the marketplace or through their online and retail stores bearing plaintiff's designs.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's designs, award all profits to plaintiff, statutory damages, all legal fees and any other relief as the court deems just.
