Man alleges LINA wrongfully terminated benefits, seeks reinstatement

SAN FRANCISCO – A Marin County man alleges his disability benefits were wrongfully terminated and is seeking reinstatement.

Curt Huettinger filed a complaint on Sept. 21 in the U.S. District Court for the Northern District of California against Life Insurance Company of North America and VMWare Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled because of Parkinson's disease and was initially paid disability benefits until the benefits were terminated in July. The plaintiff holds Life Insurance Co, of North America and VMWare Inc. responsible because the defendants allegedly denied plaintiff's claim for disability benefits despite being entitled to them under the terms of the plan.

The plaintiff seeks pay disability benefits to plaintiff plus interest, reinstatement, all legal fees plus interest and any other relief as the court deems just. He is represented by Cassie Springer Ayeni of Springer Ayeni in Oakland.
