Three California restaurants accused of using counterfeit karaoke tracks

LOS ANGELES – A North Carolina company alleges that the operators of the New Wave Restaurant in Bellflower, 80's Bar & Grille in Fullerton and That 80's Bar in Montclair used counterfeit karaoke accompaniment tracks.

Phoenix Entertainment Partners LLC filed a complaint on Oct. 6 in the U.S. District Court for the Central District of California against Morel Sand LLC, Local Motion OC LLC, Living S & G Inc. and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges it manufactures the Sound Choice karaoke tracks and graphics. The plaintiff holds Morel Sand LLC, Local Motion OC LLC, Living S & G Inc. and Does 1-10 responsible because the defendants allegedly used counterfeit products bearing plaintiff's trademark, which it alleges is likely to cause confusion with customers.

The plaintiff requests a trial by jury and seeks award plaintiff all profits and damages sustained from the unlawful act; statutory damages of no less than $50,000 per defendant; award treble, punitive and enhanced damages to plaintiff; order the defendant to deliver up for destruction all computer disk drives which contains counterfeit media; all legal fees; and any other relief as the court deems just.
