Stockton consumer alleges Wells Fargo continued to call after she requested calls to stop

SACRAMENTO – A Stockton individual alleges a bank continued to call her after she asked that the calls stop.

Doeneshia Mitchell filed a complaint on Oct. 13 in the U.S. District Court for the Eastern District of California against Wells Fargo Bank NA alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that the defendant called her numerous times in an attempt to collect a debt and she asked that the calls stop in November 2015, but the defendant began calling again in May. The plaintiff holds Wells Fargo Bank NA responsible because the defendants allegedly used an automatic telephone dialing system to contact plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages, treble damages, actual damages, punitive damages, all legal fees and any other relief the court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
