LOS ANGELES – Two Los Angeles County consumers allege a sunflower seed product was falsely advertised as safe to consume.
Larriel Williams and Lalonie Williams filed a complaint on behalf of all others similarly situated on Oct. 11 in the U.S. District Court for the Central District of California against Pepsico Inc., doing business as Spitz International, and Does 1-10 citing the Unfair Competition Law, negligence and other counts.
According to the complaint, the plaintiffs allege that they suffered damages from being misled into purchasing a food item that was unsafe to consume from a gas station in February. The plaintiffs hold Pepsico Inc., doing business as Spitz International, and Does 1-10 responsible because the defendants allegedly advertised that its Spitz Sunflower Seeds were safe to consume when the product allegedly contained maggots and dirt.
The plaintiffs request a trial by jury and seek order the defendant to engage in a corrective advertising, actual damages, restitution, punitive damages, statutory damages, all legal fees and interest plus any other relief the court deem just.
