Pension plan sues California corporation over alleged nonpayment of monthly contributions

CALIFORNIA — A labor group is suing Smart Tech Group, Inc., a California corporation, citing alleged breach of contract.

Trustees of the Southern California Ibew-Neca Pension Plan, Trustees of the Southern California Ibew-Neca Defined Contribution Trust Fund; Trustees of the Southern California Ibew-Neca Health Trust Fund, Trustees of the Southern California Ibew-Neca Supplemental Unemployment Benefit Trust Fund, Trustees of the Los Angeles County Electrical Educational and Training Trust Fund, Trustees of the National Electrical Benefit Fund, Trustees of Southern California Ibew-Neca Labor-Management Cooperation Committee, Trustees of the National Neca-Ibew Labor-Management Cooperation Committee Trust Fund, Contract Compliance Fund, and Los Angeles Electrical Workers Credit Union filed a complaint on Oct. 19, in the U.S. District Court for the Central District of California against Smart Tech Group, Inc. alleging that the California corporation failed to pay monthly contributions to the labor group.

According to the complaint, the plaintiffs allege that Trustees of the Southern California Ibew-Neca Pension Plan, Trustees of the Southern California Ibew-Neca Defined Contribution Trust Fund; Trustees of the Southern California Ibew-Neca Health Trust Fund, Trustees of the Southern California Ibew-Neca Supplemental Unemployment Benefit Trust Fund, Trustees of the Los Angeles County Electrical Educational and Training Trust Fund, Trustees of the National Electrical Benefit Fund, Trustees of Southern California Ibew-Neca Labor-Management Cooperation Committee, Trustees of the National Neca-Ibew Labor-Management Cooperation Committee Trust Fund, Contract Compliance Fund, and Los Angeles Electrical Workers Credit Union suffered damages as the result of unpaid and late paid fringe benefit contributions. The plaintiffs holds Smart Tech Group, Inc. responsible because the defendant allegedly breached their bargaining agreement with the plaintiff for failing to pay monthly contributions on behalf of their employees.

The plaintiffs seek all unpaid fringe benefit contributions, liquidated damages, damages, interest, all legal fees and any other relief as this court deems just. They are represented by Susan Graham Lovelace and Michael Y. Jung of Laquer Urban Clifford & Hodge LLP in Pasadena.
