LOS ANGELES – A manufacturer of juniors clothing alleges other garment manufacturers are using its trademark without permission.
Second Generation Inc. filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California against Baldwin Sun Inc., Kody Brand Inc., Kody Branch of California Inc., Trinh Vuong Garment Co. LTD, Cathy Trinh; Seven-Bros Enterprises Inc., and Does 1 through 10 alleging trademark infringement.
According to the complaint, the plaintiff is the owner of the trademark Made With Love Worn With Love and alleges that it suffered damages to its business. The plaintiff holds Baldwin Sun Inc., Kody Brand Inc., Kody Branch of California Inc., Trinh Vuong Garment Co. LTD, Cathy Trinh; Seven-Bros Enterprises Inc., and Does 1 through 10 responsible because the defendants allegedly used the Made with Love trademark, which the plaintiff alleges could cause confusion to its customers.
The plaintiff requests a trial by jury and seeks to enjoin the defendants from further infringing plaintiff's trademark, award damages and profits to the plaintiff, compensatory damages no less than $500,000, punitive damages, all legal fees and interest plus any other relief as the court deems just.
