Beachbody claims two individuals sell counterfeit products on eBay

LOS ANGELES – Two Rancho Cordova residents are accused of selling counterfeit exercise DVDs and kits.

Beachbody LLC filed a complaint on Nov. 28 in the U.S. District Court for the Central District of California, Western Division against David Barnett, Christopher Barnett and Does 1-10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation. The plaintiff holds David Barnett, Christopher Barnett and Does 1-10 responsible because the defendants allegedly used plaintiff's trademark on their counterfeit products and sold those products on eBay.com.

The plaintiff requests a trial by jury and seeks award profits and damage, actual damages, statutory damages, injunction against the defendants, restitution, order for the destruction of infringing materials, all legal fees and interest plus any other relief as the court deems just. It is represented by Christopher D. Johnson, Christopher Q. Pham and Marcus F. Chaney of Johnson & Pham LLP in Woodland Hills.
