Consumer alleges vehicle purchased at CarMax Auto Superstores was misrepresented

LOS ANGELES – A Burbank car dealership is accused of falsely representing that its vehicles are certified.

Allan Courseault Jr. filed a complaint on Dec. 5 in the U.S. District Court for the Central District of California against CarMax Auto Superstores California LLC and Does 1 through 10 alleging violation of the Consumer Legal Remedies Act and other counts.

According to the complaint, the plaintiff alleges that he suffered damages from purchasing a vehicle from the defendant in 2014. The plaintiff holds Carmax Auto Superstores California LLC and Does 1 through 10 responsible because the defendants allegedly sold a vehicle to the plaintiff that did not go through a complete inspection report but marketed the vehicle as "certified."

The plaintiff requests a trial by jury and seeks general damages, restitution, rescission of the purchase contract, incidental and consequential damages, punitive and statutory damages, all legal fees and interest plus any other relief as this court deems just. He is represented by Hallen D. Rosner and David L. Herman of Rosner, Barry & Babbitt LLP in San Diego.
