Merrick Bank Corp. accused of telephone harassment

LOS ANGELES – A Cudahy consumer alleges he was harassed by frequent phone calls from a debt collector.

Jose Diaz filed a complaint on Dec. 6 in the U.S. District Court for the Central District of California, Western Division against Merrick Bank Corp. alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2016, he suffered damages from being harassed by frequent collection calls on his cellular telephone from the defendant. The plaintiff holds Merrick Bank Corp. responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiff and continued to call him after he revoked his consent.

The plaintiff requests a trial by jury and seeks statutory damages, injunction against the defendant, all legal fees and any other relief as the court deems just. He is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
