L. Love Inc., St. Bernard Sports Inc. alleged to have sold clothing using infringing fabric designs

LOS ANGELES – An apparel wholesaler and a retailer are accused of selling clothing with infringing fabric designs.

Fabric Selection Inc. filed a complaint on Dec. 6 in the U.S. District Court for the Central District of California against L. Love Inc., St. Bernard Sports Inc. and Does 1 through 10 citing copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its SE40412 design used. The plaintiff holds L. Love Inc., St. Bernard Sports Inc. and Does 1 through 10 responsible because the defendants allegedly unlawfully manufactured and sold garments bearing plaintiff's design to customers.

The plaintiff requests a trial by jury and seeks injunction against the defendants from further infringing plaintiff's design, order the defendants to destroy all infringing materials, actual damages, profits, statutory damages, all legal fees and any other relief as the court deems just.
