Pivotal Payments Inc. accused of invading consumer's privacy

LOS ANGELES – A Riverside County woman alleges a company that she has never had a business relationship with invades her privacy with repeated phone calls.

Keisha Newsom filed a complaint on behalf of others similarly situated on Dec. 10 in the U.S. District Court for the Central District of California against Pivotal Payments Inc., doing business as Capital Processing Network, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in June 2015, she suffered damages from receiving several unwanted phone calls on her cellular telephone from the defendant. The plaintiff holds Pivotal Payments Inc. responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiff without her consent.

The plaintiff requests a trial by jury and seeks statutory damages, injunctive relief and any other relief as the court deems just. She is represented by Joshua B. Swigart and Yana A.
