Cabeau seeks declaration of noninfringement over travel pillow

Patents 07

LOS ANGELES – A Woodland Hills corporation that manufactures travel products alleges it was wrongfully accused of patent infringement by a New York company.

Cabeau Inc. filed a complaint on Dec. 14 in the U.S. District Court for the Central District of California, Western Division against Bedgear LLC seeking declaratory judgment.

According to the complaint, the defendant is a bedding manufacturer and has accused the plaintiff of violating its patents with the plaintiff's Evolution Cool Travel Pillow product. The plaintiff alleges that to its knowledge, the defendant has never produced a travel pillow.

The plaintiff requests a trial by jury and seeks declaration that the plaintiff does not infringe the defendant's patents, all legal fees and any other relief as the court deems just. It is represented by Corey A. Donaldson of Koppel Patrick Heybl & Philpott in Westlake Village.
