Rincon Distribution claims Dodge Delaware is using Terrain mark without authorization

LOS ANGELES – A Ventura flooring manufacturer claims a Pennsylvania business is unlawfully using its trademark.

Rincon Distribution LLC filed a complaint on Dec. 14 in the U.S. District Court for the Central District of California, Western Division against Dodge Delaware Inc. alleging trademark infringement.?

According to the complaint, the plaintiff alleges that it uses the Terrain mark for high-quality stone, ceramic, glass and other flooring. The plaintiff holds Dodge Delaware Inc. responsible because the defendant allegedly used plaintiff's Terrain mark to offer overlapping services.

The plaintiff requests a trial by jury and seeks enjoin the defendant, damages of at least $100,000, profits of at least $100,000, enhanced damages, exemplary damages, deliver up for destruction all infringing materials, all legal fees and any other relief as the court deems just. It is represented by Marina Lang and Michael D. Harris of SoCal IP law Group LLP in Westlake Village.
